$1.5 million verdict for client
May 14, 2010 – Philadelphia, Pennsylvania – Litigation Department Chair, Doug Smillie, assisted by Susan Royster, secured a $1.5 million verdict in favor of our client, Infocrossing, Inc., after a four-day jury trial in federal court in Philadelphia. The issues involved competing claims between Infocrossing, a provider of IT services and solutions to the healthcare payer industry, and a large provider of business process outsourcing services to the government health plan market. The jury was unanimous in its verdict, which included an award of interest and attorney's fees in favor of Infocrossing.
"This is exactly the kind of dispute which we handle for clients every day," said Mr. Smillie. "Where a business solution to commercial issues is not possible, we have no hesitancy in pursuing other avenues, including litigation."
Infocrossing sought payment of in excess of $1 million, and the defendant asserted a counterclaim of more than $2 million, which the jury rejected entirely. The defendant was represented by a 400 lawyer regional defense firm based in Philadelphia. The issues at trial involved contract interpretation within the health care insurance industry, thus implicating several of FL&B's areas of practice, including business law, commercial litigation and health care.

Personally, I was also reminded once again of the invaluable service that individual citizens provide when serving as jurors. This trial interrupted the jurors' lives for the better part of a week, and that sacrifice in the name of civic duty is truly appreciated," said Smillie.
